Terms of Service for Idle Survival Island Builder

Agreement to Terms

By downloading, installing, or using the Idle Survival Island Builder mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Developer Information

Description of Service

Idle Survival Island Builder is a mobile survival and building game that provides:

• Island survival gameplay with resource gathering and management
• Building construction and upgrade systems
• Helper NPC characters with AI task systems
• Mission and achievement progression
• Multiple world exploration
• Offline resource generation and auto-save functionality
• Optional in-app purchases for game currency and features
• Ad-supported free gameplay with option to remove ads

Eligibility

The App is rated for ages 4+ and is suitable for all ages. If you are under 13 years old, you must have parental or guardian consent to use the App and make any in-app purchases.

License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

You May:

• ✓ Install and use the App on your personal devices
• ✓ Play the game and track your progress
• ✓ Make optional in-app purchases
• ✓ Use the App offline (with auto-save)
• ✓ Share screenshots on social media

You May Not:

• ✗ Reverse engineer, decompile, or disassemble the App
• ✗ Copy, modify, or create derivative works
• ✗ Sell, rent, lease, or sublicense the App
• ✗ Use the App for commercial purposes
• ✗ Remove or alter any copyright notices
• ✗ Use automated tools, bots, or cheats
• ✗ Attempt to circumvent ads or payment systems
• ✗ Exploit bugs or glitches for unfair advantage
• ✗ Hack or modify game files or save data externally

User Account

No Registration Required: The App does not require user accounts, registration, or login. All game data is stored locally on your device using Unity's save system with auto-save every 60 seconds.

In-App Purchases (IAP)

The App offers the following in-app purchases:

Available IAP Products:

• Small Gold Pack - Consumable currency pack
• Medium Gold Pack - Consumable currency pack
• Large Gold Pack - Consumable currency pack
• Special Pack - Non-consumable special item bundle
• Character Skin - Non-consumable cosmetic customization
• Remove Ads - Non-consumable permanent ad removal

Purchase Terms:

• Payment: Charged to your Apple App Store or Google Play Store account
• Confirmation: Payment charged at purchase confirmation
• Virtual Currency: Gold and other currencies have no real-world value
• No Refunds: All purchases are final and non-refundable except as required by law
• Restore Purchases: Non-consumable purchases can be restored via Settings
• Parental Controls: Parents can restrict IAP in device settings

Consumable vs. Non-Consumable:

• Consumable (Gold Packs): Used once, cannot be restored
• Non-Consumable (Skins, Pack, Remove Ads): Permanent, can be restored

Advertisements

The free version displays ads powered by Google AdMob:

Ad Types:

• Banner Ads: Small ads displayed during gameplay
• Interstitial Ads: Full-screen ads shown between gameplay sessions (frequency capped)
• Rewarded Video Ads: Optional ads you can watch for in-game rewards

Ad Personalization:

• On iOS 14.5+, we request permission for ad personalization (IDFA tracking)
• Declining doesn't affect gameplay, only ad relevance
• GDPR compliant with User Messaging Platform (UMP) for European users
• All ads are family-friendly and age-appropriate

Removing Ads:

You can permanently remove all ads by purchasing the "Remove Ads" in-app purchase. This is a one-time non-consumable purchase that removes banner, interstitial, and rewarded video ads.

Virtual Items and Currency

The App includes virtual items and currency (gold, resources, upgrades, etc.) that can be earned through gameplay or purchased:

• Virtual items have no real-world value
• Virtual currency cannot be exchanged for real money
• We reserve the right to modify, remove, or add virtual items
• Virtual items cannot be transferred between users
• Loss of virtual items due to bugs will be addressed on best-effort basis

Game Progress and Save Data

Local Storage:

• All game progress is saved locally on your device
• Auto-save occurs every 60 seconds
• Save on app close or focus loss
• No cloud save or cross-device sync

Data Loss:

We are not responsible for loss of game progress due to:

• Device damage, loss, or theft
• Uninstalling the app
• Device upgrade or reset without backup
• Operating system bugs or crashes
• Device storage issues

Important: Uninstalling the app deletes all local game data permanently. Back up your device regularly.

Intellectual Property

All content in the App, including but not limited to graphics, code, game mechanics, characters, islands, missions, and text, is owned by Simon Hoe/PuzzleCrownStudios or licensed to us.

Trademarks:

"Idle Survival Island Builder" and associated logos are trademarks of PuzzleCrownStudios. You may not use these marks without written permission.

Game Content:

• Game mechanics and systems are proprietary
• 3D models, textures, and art assets are copyrighted
• Code and algorithms are protected intellectual property
• You may share screenshots and gameplay videos for personal/promotional use

User Conduct

You agree to use the App responsibly and not to:

• Violate any laws or regulations
• Infringe on others' intellectual property rights
• Transmit viruses or malicious code
• Interfere with the App's operation or servers
• Harass, abuse, or harm others
• Use cheats, exploits, hacks, or third-party tools
• Manipulate save files externally
• Attempt to acquire IAP items without payment
• Share or sell game accounts (N/A - no accounts)
• Use the App for any fraudulent or illegal purpose

Updates and Changes

We may update the App from time to time to:

• Add new features, content, or islands
• Fix bugs and improve performance
• Balance gameplay and economy
• Update third-party SDKs (AdMob, Unity IAP)
• Comply with platform requirements

Updates may be automatic or require manual download. Continued use after updates constitutes acceptance of changes.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation
• Accuracy or reliability of content

We do not guarantee that the App will be free from bugs, viruses, or other harmful components.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Loss of game progress or virtual items
• Device damage or data loss
• Indirect, incidental, or consequential damages
• Loss of profits or revenue
• Loss of data or business interruption

Our total liability shall not exceed the amount you paid for IAP purchases in the 12 months prior to the claim, or $100 USD, whichever is less.

Indemnification

You agree to indemnify and hold harmless PuzzleCrownStudios, Simon Hoe, and our affiliates from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any laws or third-party rights

Data and Privacy

Your use of the App is governed by our Privacy Policy. By using the App, you consent to data collection and use as described in the Privacy Policy.

Key Privacy Points:

• All game data stored locally on your device
• No user accounts or personal information required
• Minimal data collection
• Third-party services (AdMob, Unity) may collect analytics
• IDFA tracking for ad personalization (iOS, with consent)
• GDPR and COPPA compliant

Termination

We reserve the right to:

• Discontinue the App at any time
• Modify or remove features
• Block access if you violate these Terms

You may terminate by uninstalling the App. Upon termination, all licenses granted to you will cease, and you must stop using the App.

Governing Law and Disputes

These Terms are governed by the laws of [Your State/Country]. Any disputes shall be resolved through:

• Good faith negotiation first
• Binding arbitration if negotiation fails
• Small claims court for claims under jurisdictional limit

You waive any right to class action lawsuits or jury trials.

Apple and Google Requirements

Apple App Store:

If you download the App from the Apple App Store, you acknowledge that:

• Apple is not responsible for the App or its content
• Apple has no obligation to provide support
• In case of non-conformance, Apple's liability is limited to refund of purchase price
• Apple is a third-party beneficiary of these Terms

If you download the App from Google Play Store, you acknowledge that:

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Updating the "Last Updated" date
• Displaying an in-app notification
• Posting on our website

Continued use after changes constitutes acceptance of the updated Terms.
