Agreement to Terms

By downloading, installing, or using the BrainBreak mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

BrainBreak is a daily puzzle application that provides:

One new puzzle per day (Nonogram, Flow Free, Path Logic, or Sudoku)
Streak tracking and statistics
Access to past puzzles (with limitations for free users)
Optional premium subscription for enhanced features

Eligibility

The App is available to users of all ages. If you are under 13 years old, you must have parental or guardian consent to use the App.

License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

You May:

✓ Install and use the App on your personal devices
✓ Play puzzles and track your progress
✓ Share your results on social media
✓ Use the App offline

You May Not:

❌ Reverse engineer, decompile, or disassemble the App
❌ Copy, modify, or create derivative works
❌ Sell, rent, lease, or sublicense the App
❌ Use the App for commercial purposes
❌ Remove or alter any copyright notices
❌ Use automated tools or bots to interact with the App
❌ Attempt to circumvent ads or premium features

User Account

No Registration Required: The App does not require user accounts or registration. All data is stored locally on your device.

Free Version Features

The free version of BrainBreak includes:

✓ One daily puzzle (free, unlimited access)
✓ Access to yesterday's puzzle (requires watching an ad)
✓ Streak tracking and statistics
✓ Hints available (requires watching an ad per hint)
✓ Share functionality
❌ Ads displayed (rewarded & interstitial)
❌ Limited archive access (yesterday only)

Premium Subscription

Premium Features

Premium subscribers receive:

✓ **Ad-free experience** (no rewarded or interstitial ads)
✓ **Full archive access** (30 days of past puzzles)
✓ **Unlimited hints** (no ads required)
✓ Support app development

Subscription Terms

**Pricing**: [To be determined at launch]
**Billing Cycle**: Monthly or yearly (auto-renewing)
**Payment**: Charged to your Apple App Store or Google Play Store account
**Auto-Renewal**: Subscriptions auto-renew unless canceled 24 hours before the end of the period
**Cancellation**: Cancel anytime through your app store account settings
**No Refunds**: Subscriptions are non-refundable except as required by law

Managing Your Subscription

**iOS**: Settings → [Your Name] → Subscriptions
**Android**: Google Play Store → Account → Subscriptions

The free version displays ads powered by Google AdMob:

**Rewarded Ads**: Watch to unlock hints or archive puzzles
**Interstitial Ads**: Shown after puzzle completion (frequency capped)
**Age-Appropriate**: Ads comply with COPPA for children

You can remove ads by upgrading to premium.

Intellectual Property

All content in the App, including puzzles, graphics, code, and text, is owned by Simon Hoe or licensed to us. The puzzles are algorithmically generated and are not copyrighted individually, but the generation algorithms and app code are proprietary.

Trademarks

"BrainBreak" and associated logos are trademarks of Simon Hoe. You may not use these marks without written permission.

User Conduct

You agree to use the App responsibly and not to:

Violate any laws or regulations
Infringe on others' intellectual property rights
Transmit viruses or malicious code
Interfere with the App's operation
Harass, abuse, or harm others
Engage in cheating or exploiting bugs

Data and Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to data collection and use as described in the Privacy Policy.

Key Privacy Points:

All puzzle data stored locally on your device
No personal information required
Minimal data collection
Third-party services (AdMob, EAS) may collect analytics

Disclaimers

AS-IS Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or completeness
Uninterrupted or error-free operation

No Guarantees

We do not guarantee that:

The App will be available at all times
Puzzles will always be solvable (though we test extensively)
Your data will never be lost (we recommend iCloud/Google backup)
Ads will always load successfully

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMON HOE SHALL NOT BE LIABLE FOR ANY:

Indirect, incidental, special, or consequential damages
Loss of data, profits, or goodwill
Interruption of service
Damages arising from use or inability to use the App

Maximum Liability: Our total liability shall not exceed the amount you paid for the App (if premium) in the past 12 months, or $10 USD (whichever is greater).

Indemnification

You agree to indemnify and hold harmless Simon Hoe from any claims, damages, losses, or expenses (including legal fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights

Changes to the App

We reserve the right to:

Modify or discontinue the App at any time
Change features, puzzle types, or functionality
Update these Terms
Change pricing for premium subscriptions

We will provide notice of material changes through:

In-app notifications
Updated Terms with new "Last Updated" date
Email (if provided)

Continued use after changes constitutes acceptance.

Termination

Your Rights

You may stop using the App at any time by uninstalling it from your device.

Our Rights

We may terminate or suspend your access to the App if:

You violate these Terms
You abuse or exploit the App
Required by law
We discontinue the App

Upon termination:

Your license to use the App ends
You must uninstall the App
Premium subscriptions will not be refunded (except as required by law)

Governing Law

These Terms are governed by the laws of the Denmark, without regard to conflict of law principles.

Dispute Resolution

Any disputes shall be resolved through:

2. **Mediation**: If informal resolution fails

3. **Arbitration**: Binding arbitration (if required by your jurisdiction)

4. **Small Claims Court**: You may bring claims in small claims court

Class Action Waiver

You agree to bring claims only in your individual capacity, not as part of a class action.

Apple App Store & Google Play Store

If you downloaded the App from the Apple App Store or Google Play Store, you also agree to their respective terms:

In case of conflict, the app store terms take precedence for transactions.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Simon Hoe regarding the App.
